WAILUKU – A Wailuku man was taken into custody to complete a six-month jail term for illegally restraining a woman who said she was beaten and threatened while he held her captive in his truck.

Jordan Ware, 34, also was placed on four years’ probation when he was sentenced Thursday.

Originally charged with kidnapping, he had pleaded no contest to a reduced charge of first-degree unlawful imprisonment of the woman on July 22, 2016. Charges of felony abuse, abuse and interfering with reporting of an emergency were dismissed in exchange for his plea.

Speaking in court Thursday, the woman said, “I had to put in a lot of work to heal from the torture that Jordan Ware put me through.”

That night, “I honestly did not believe I was going to live,” she said.

“I thought my life was over,” she said. “He kept me captive, beat me, strangled me and threatened to take my life.”

She said she wondered whether her family and friends would find her body after Ware “said he was going to take me to Kahakuloa and presumably throw me off the cliff.”

In previous conversations, Ware had mentioned how easy it would be to kill someone that way, the woman said.

“He is a very violent person,” she said. “I am here to stand up for myself and the numerous other women that Jordan has endangered.

“I was very fortunate to have the grace of God on my side on the night of July 22, 2016, and my life was thankfully spared.”

Ware, who is a Navy veteran, asked for a chance to keep the conviction off his record. His attorney, Elizabeth Cuccia, said letters from friends and family showed that Ware is “someone that’s out there helping and trying his best to better his life.”

After previously spending two days in jail, Ware asked to be spared any additional jail time.

Cuccia said the result of a lie detector test that Ware took was submitted in the case.

“And that was a huge part of how we were able to come to this deal,” she said. “He was seen as being truthful when he said he did not hurt her that night.”

Second Circuit Judge Peter Cahill noted that Ware told a police officer he didn’t remember what happened that night.

When he later took the lie detector test, “his memory suddenly got better and all of a sudden his statements were truthful,” Cahill said.

He said some of the questions were emotional, asking if Ware loved the woman and knew why she felt he had physically hurt her that night.

“That question blames the victim,” Cahill said. “Maybe those are truthful statements, but they’re of no benefit.

“The issue is what was happening that night. He’s being sentenced because of what he did.”

Cahill said he appreciated what the woman said in court, which was the same as what was included in police reports.

He denied Ware’s request for a deferral, citing “the nature of the circumstances of the case.”

In sentencing Ware, the judge said he was partially following a plea agreement between the defense and prosecution that allowed the prosecution to seek a 30-day jail term.

Ware was ordered not to consume illegal substances and to stay away from people using illegal substances. He also was ordered to complete a domestic violence intervention program.
