SHIAWASSE COUNTY, MI -- A New York man has filed a federal lawsuit against Mark Latunski, the Shiawasse County man who was charged with open murder and mutilation of a body after 25-year-old Kevin Bacon was found dead in his basement three days after Christmas.

James Carlsen of New York filed the lawsuit in U.S. District Court Wednesday, June 10, saying he fled Latunski’s Bennington Township home after cutting himself free from leather straps to escape just two months before Bacon’s death.

The lawsuit accuses Latunski of neglect and gross negligence, battery and false imprisonment.

Latunski was charged with open murder and mutilation of a body in the case of Bacon, a hair stylist from Swartz Creek, accused of stabbing Bacon in the back and hanging him from his ankles, his throat cut and parts of him eaten.

In February, Latunski was found not competent to stand trial for Bacon’s death, and last month, a second evaluation also found him not competent, Douglas Corwin Jr., Latunksi’s public defender said Friday, June 12.

Corwin said Latunski remains in the Shiawassee County Jail, waiting for an opening so that he can be housed at the state’s Center for Forensic Psychiatry.

“The facts of this case are straight out of a horror movie ... Carlsen traveled from New York to Michigan for the purpose of engaging in consensual BDSM with ... Latunski,” the lawsuit says. “What Mr. Carlsen did not expect is that during his stay ... Latunski would end up chaining him down in his basement and holding him captive. After he thought ... Latunski had fallen asleep, Mr. Carlsen, terrified, cut himself loose using a butcher knife, and ran down the street in the middle of nowhere in order to call the police.”

The lawsuit says Carlsen met Latunski’s husband online and eventually traveled to visit Latunski and his husband at their home.

But after arriving at the home, Carlsen says he found only Latunski, who would go on to retrieve “locks, chains, and leather straps to tie Mr. Carlsen down in his basement, stating that he was going to bed and threateningly declaring (that Carlsen) “wasn’t going anywhere," the lawsuit says. “After he thought ... Latunski had fallen asleep, Mr. Carlsen, terrified, was eventually able cut himself loose from the straps using a butcher knife, found his cell phone and escaped from the home, running down the street in the middle of nowhere in order to call the police.”

MLive-The Flint Journal has reported that two men ran frantic and terrified from Latunski’s basement on separate occasions just months before Kevin Bacon was allegedly slain at the home, according to 911 call recordings obtained by The Journal through the Freedom of Information Act request.

Carlsen says in his lawsuit that he was one of those two men.

In one of the 911 recordings, a man told a police dispatcher that he came from New York to Michigan for work purposes and describes a man hitting on him at the bus station upon his arrival and going out to grab a drink before he was held captive and eventually able to flee.

“I’m from New York. I’m walking down the street with a butcher’s knife. Sweetheart, I need help," he tells the dispatcher on the emergency call.

Michigan State Police have confirmed troopers were called to the area and provided the man a ride to a local gas station. The man then contacted Latunski and returned to the home on the same evening, according to state police.
